1. General

1.1 These Terms of Service (“Terms”) apply to all purchases made through Smartiz Home US (“we”, “our”, “the Company”).
1.2 By placing an order on our website, you (“the Customer”) agree to these Terms.
1.3 Smartiz Home US operates a direct-to-consumer fulfillment model (dropshipping); items may ship directly from our partnered suppliers.
1.4 Customers are responsible for reading and understanding these Terms prior to ordering.


2. Product Information

2.1 Product descriptions, measurements, colors, and images are provided by our suppliers.
2.2 Minor variations in color, size, packaging, or design may occur and are not considered defects.
2.3 By purchasing, the Customer accepts potential minor variations.


3. Prices & Payments

3.1 Prices are listed in USD and may be adjusted at any time.
3.2 Orders are processed only after successful payment.
3.3 The Customer must provide accurate billing information.
3.4 Fraudulent chargebacks or payment disputes will be legally challenged.


4. Order Processing & Shipping

4.1 Orders are processed within 1–3 business days.
4.2 Estimated delivery time (US only):

  • Standard: 6–15 business days

  • Peak season: up to 20 business days
    4.3 Shipping times are estimates; delays due to carriers, weather, or logistics are not grounds for refunds.
    4.4 Orders cannot be canceled once processed or shipped.
    4.5 Customers must provide correct addresses; errors may result in lost packages without refund.


5. Tracking Information

5.1 A tracking number will be sent via email upon shipment.
5.2 Tracking may take 1–3 business days to appear.
5.3 Packages marked Delivered by the carrier are considered delivered.
5.4 We do not refund packages marked Delivered. Customers must file a claim with the carrier for lost/stolen items.


6. Returns & Refunds

6.1 Returns may be requested within 14 days of receipt.
6.2 Items must be unused, undamaged, and in original packaging.
6.3 Customers are responsible for return shipping and any import fees.
6.4 A valid Track & Trace number is required; returns without tracking cannot be refunded.
6.5 Refunds are issued only after the returned item is received and inspected.
6.6 Return shipping costs are non-refundable.


7. Non-Returnable Items

  • Used, worn, or damaged products

  • Items missing original packaging or accessories

  • Items returned without a tracking number

  • Items damaged due to Customer misuse


8. Damaged or Incorrect Items

8.1 Contact us within 7 days of delivery if an item is damaged or incorrect, with photos/video evidence.
8.2 After verification, we may provide:

  • Replacement item

  • Partial refund

  • Full refund
    8.3 Items damaged by the Customer are not eligible.


9. Order Cancellations

9.1 Orders may only be canceled before shipment.
9.2 Once processed or shipped, cancellations are not possible.
9.3 Refusing delivery does not qualify for a refund.


10. Chargebacks & Disputes

10.1 Customers must contact our support before filing a chargeback.
10.2 Filing a chargeback without contacting us may be considered breach of contract.
10.3 We will provide tracking data, delivery confirmation, communication logs, and Terms acceptance for dispute resolution.
10.4 Fraudulent disputes (e.g., “item not received” when tracking shows Delivered) will be contested legally and via the payment processor.
10.5 Customers agree not to file unauthorized or fraudulent claims.


11. Warranty

11.1 We provide a 30-day warranty against manufacturing defects.
11.2 Warranty does not cover accidental damage, misuse, or normal wear and tear.


12. Limitation of Liability

12.1 Smartiz Home US is not liable for:

  • Carrier delays

  • Lost packages due to incorrect addresses

  • Minor product variations

  • Indirect or consequential damages
    12.2 Maximum liability is limited to the purchase price of the product.


13. Binding Arbitration

Any disputes or claims arising from these Terms will first be addressed through binding arbitration in the State of Wyoming.

  • This includes disputes over chargebacks, refunds, or product claims.

  • Arbitration costs are shared equally, and the decision is final and binding.


14. Privacy

14.1 Customer data is processed securely in compliance with US privacy laws.
14.2 Data is only shared with fulfillment partners necessary for order processing.


15. Governing Law

These Terms are governed exclusively by the laws of the United States, State of Wyoming.
All disputes will be resolved in US courts, unless resolved via arbitration (see Section 13).
